Terms and Conditions of Use

These Terms and Conditions of Use (the “Terms”) govern the use of SRC Music Distribution, the digital music distribution platform available at distribution.srcmusic.com. By creating an account, signing in or distributing a release, you accept these Terms in full. If you do not agree, do not use the platform.

1. Who we are

SRC Music Distribution (“we”, “us”, “the platform”) is a digital music distribution service. You can contact us at info@srcmusic.com for anything related to these Terms.

2. Eligibility and your account

  • You must be at least 18 years old, or have the consent of your legal guardian, and be able to enter into a binding contract.
  • You must provide accurate data and keep it up to date. The account is personal: you are responsible for everything that happens with your username and password.
  • One account per person or project. Duplicate or fake accounts are not allowed to bypass limits, sanctions or blocks, and you may not impersonate another person, artist, band or label.
  • Email verification. To use the platform’s features you must verify the email address of your account.
  • We may require two-factor authentication or additional verification for payments and sensitive operations, and documentation proving the ownership of the rights when we need it for a payment or an investigation.
  • Blocking of accounts, devices and IP addresses. We may suspend or permanently close an account, and block the IP addresses, devices or connection ranges from which it is used, when there are signs of fraud, attacks, abuse, artificial streaming or a breach of these Terms. The block may be immediate and without prior notice, and it does not entitle you to a refund of your plan.

3. The distribution agreement (distribution contract)

Besides these Terms, the act of sending a release for distribution means you sign a distribution contract for that release. Before creating your first release, the platform asks you to accept these Terms expressly (checkbox + date of acceptance), and that acceptance is recorded in your account (version of 25/10/2026). If we update the text, we will ask you to accept the new version again: until you do, you will not be able to create new releases, although your existing releases keep working normally.

You can consult and sign the contract at any time in your panel, in Terms and conditions → Distribution contract.

4. The service

  • We deliver your music to the digital shops and platforms we work with (streaming, downloads, social and video platforms), we collect the reports of reproductions and earnings from each of them and we pay you your share.
  • Distribution is done through our distribution partners. We do not guarantee that a shop accepts a release, nor that it stays available in it, nor a specific number of reproductions.
  • We may reject or remove a release if it does not meet the technical requirements, these Terms, or the rules of the shops and platforms.
  • We are not the owner of your music: you keep all the rights over your recordings and your songs. We only receive the authorisation described in section 6.

5. Technical requirements and review

  • Upload only audio WAV of the best quality, with cover art, metadata and credits complete and truthful (titles, authors, performers, producers, language, territories…).
  • Every release is reviewed by our team before being sent to the shops. The review may take a few days; we may ask you for changes or reject it with the reason.
  • Release dates cannot be earlier than the date the platform allows at the time of upload (our calendar sets it).
  • Do not upload content that infringes third-party rights (samples without clearance, unauthorised remixes, voices or music generated by tools without the required rights), offensive or illegal content, or content intended to manipulate reproductions (artificial streaming).

6. Rights and authorisation

You declare and guarantee that you own or control all the rights over the content you upload and that its distribution through the shops does not infringe any third-party rights. You grant us a non-exclusive, worldwide, free authorisation, for the duration of the distribution of each release, to:

  • reproduce, encode, store and deliver your recordings and cover art to the shops and platforms we work with;
  • communicate them publicly, let them be listened to and, where applicable, sold in those shops;
  • collect the earnings generated by the reproductions and shares, on your behalf, and pass them on to you;
  • use your name, artist name, cover art and metadata to promote the release inside the shops and in our own channels.

This authorisation does not transfer ownership of your music and ends when the release is removed from distribution, except for the copies already delivered and stored in the shops and for the accounting of the period in which it was available.

7. Takedown and unavailability

You can request the removal (takedown) of a release from your panel or by writing to us. The release will stop being delivered to the shops and will be requested for removal from them; some of them may take days or weeks to complete it. We may also withdraw a release if these Terms, the law or the requirements of the shops are breached, informing you if possible.

8. Distribution to third parties: collaborators

If a track is produced with collaborators, we can define in our system the part of that track that belongs to each collaborator (by its UPC). Collaborators see only their part, in a view-only account, and receive it in their wallet. The owner of the release remains responsible for the accuracy of the sharing and for the rights of all participants.

9. Prices, shares and payments

  • The platform has plans with different features and limits (releases, artists, labels and royalty percentage). The percentage of each plan is the part of the gross earnings that belongs to you; the rest is our distribution commission. You can consult the price and conditions of each plan in Plans.
  • Earnings are calculated on the gross reports of the shops (before the percentage of your plan) and are credited to your wallet once our team approves them.
  • The withdrawal request is made from the wallet, subject to the minimum amount and the payment methods available (PayPal, bank transfer and the other methods shown in the panel).
  • You are responsible for the tax obligations derived from your income and for the accuracy of the payment data.
  • Earnings caused by fraudulent or manipulated reproductions (“artificial streaming”), or that have been reduced by a shop after the report, may be cancelled or reversed.
  • Shop penalties. The shops may charge the distributor fees or penalties for artificial streaming or for other breaches of their rules, and they pass those charges on to us; as an example, Spotify charges a per-track penalty when more than 90 % of the streams of a track in a month are artificial. Those charges, and the costs of dealing with them, are passed on to the user responsible: we may deduct them from your earnings, offset them against them or claim them from you directly, and repeated cases can lead to the definitive removal of the catalogue or the closure of the account.
  • If a shop removes content or corrects its figures after paying, we may deduct the amount from your following settlements.
  • Earnings that are not withdrawn or claimed within 3 years may be lost, after a notice to the account’s email address if it is valid.

10. Artificial streaming and fraud

An artificial stream is any reproduction that does not reflect genuine listening by a real person, and any attempt to manipulate the figures, the charts or the recommendation systems of the shops. The following are expressly prohibited:

  • using bots, scripts, automated players, click farms, stream farms or devices playing on a loop;
  • buying or selling reproductions, listeners, followers or playlist placements, including “guaranteed streams” and “promotion” services that promise numbers in exchange for money;
  • playing your own tracks in an automated way or organising exchanges of plays between accounts, groups or creators;
  • using third-party, stolen or mass-created accounts, or VPNs and country changes to simulate audiences that do not exist;
  • manipulating metadata, cover art, genres or artist names to deceive the shops’ systems or to appear in other artists’ profiles;
  • uploading content generated or published in bulk without the necessary rights or without disclosure when the shop requires it.

If we detect or are informed of artificial streaming or fraud on your releases:

  • the affected reproductions do not generate royalties and are removed from the public figures;
  • the shops may remove the track from their playlists, from their algorithms or from the catalogue itself, and may charge the distributor a penalty per flagged track;
  • we may withdraw the release or the whole catalogue from distribution, withhold or reverse the earnings obtained, apply the charges and costs to your wallet and suspend or close your account;
  • in serious or repeated cases we may close the account permanently, block new registrations from the same person, device or connection, and inform the shops and the competent authorities.

If a third party offers you these services, do not hire them and let us know: it is the fastest way to lose your catalogue and your earnings.

11. Breaches and their consequences

Depending on the seriousness we may act progressively, but we are not obliged to do so:

  • Minor breach: warning and a period to correct it. If it is not corrected, the release is paused.
  • Serious breach (fraud, artificial streaming, infringement of third-party rights, illegal content, impersonation, breach of the shops’ rules): the release or the catalogue is removed from distribution, the account is suspended, the earnings may be retained to cover penalties, reversals, expenses and claims, and access may be blocked from the IP addresses or devices involved.
  • Repeated or aggravated breach: permanent closure of the account, with loss of the earnings linked to the breach and without any right to a refund of the plan or of the amounts already paid.

We may also retain or offset earnings to cover the charges that the shops pass on to us, reversals of payments, refunds to listeners and the reasonable costs of investigating the case.

You are responsible towards third parties and towards us. If a claim by a shop, a platform, another artist or a third party arises from your content or from your breach of these Terms, you will bear the resulting damages and expenses (including reasonable legal fees) and you will collaborate with us in defending the claim.

12. Anti-fraud policy and strike system

This policy forms part of these Terms and applies to every account. It takes effect on its publication date (25/10/2026). Where the law requires it, it does not affect the rights you have as a consumer.

12.1 Definitions

Fraud means any activity that breaches the law, these Terms or the rules of the shops and streaming services where music is published. In particular, and without limitation, the following are fraud:

  • unauthorised exploitation of material protected by copyright;
  • infringement of any law that regulates the ownership of rights;
  • use of artist, band or label names, or artwork, that may confuse listeners or create false expectations about the content (musical spam and misleading content);
  • use of bots or other means to “click” payment-generating links while pretending to be listeners (click fraud);
  • uploading distorted, silenced or otherwise deceptive audio in order to generate revenue;
  • use of manual or automated resources to stream and monetise content in breach of the rules of the services where it is published;
  • use of manual or automated resources to monetise content unlawfully through digital fingerprinting or content-matching systems.

Legitimate earnings are the result of a real and lawful exploitation of content. Illegitimate earnings are the result of any fraudulent exploitation or activity.

Strike means a sanction applied to an account that breaches this policy. There are two levels, Strike 1 and Strike 2, from lower to higher severity. They are cumulative. Depending on the impact of the breach, the higher level may be applied directly.

12.2 Principles and our controls

Fraud in any form is unacceptable. It harms other creators, damages copyrights and reputations, and reduces the amounts available to honest artists. We investigate every indication of fraud rigorously and act firmly and in a controlled way. To do so, we:

  • monitor sales data over time and compare it with other information (artist profiles, account details, social media, etc.) to detect irregular activity;
  • fingerprint our whole catalogue and every new track and compare them with reference databases, to prevent duplicate uploads, “white noise”, empty tracks, copyrighted material and other unauthorised activity;
  • run quality control on metadata to detect content that could amount to musical spam, misleading content or other fraud.

12.3 How we handle suspected fraud

If we detect or suspect unauthorised activity in an account (including bot streams, click fraud, musical spam or abusive use of content-matching monetisation), we will notify you through our strike system, which may end in the blocking of the account. We may block and withhold earnings linked to content that, in our sole discretion, breaches these Terms.

12.4 Severity levels

  • F0 · Critical account issues: profile with false, deliberately incomplete or third-party information or content; repeated IP activity that is inconsistent with the declared country; earnings generated without complete profile information.
  • F1 · Click fraud, misleading content, musical spam and/or artificial streams: releases by unknown artists that generate a large number of streams or views (and revenue) in a short time without a credible fan base; sudden, suspicious growth in sales without matching profile views or social media activity; any attempt to take advantage of well-known artists’ names, song titles or other protected audiovisual content to attract clicks; hiring growth services that sell artificial streams or followers.
  • F2 · Copyright, intellectual property or trademarks: confirmed impersonation of an artist, label or company; unauthorised use of trademarks, distinctive signs, or song or album titles; unauthorised samples; protected material from a rightsholder who did not authorise publication; an infringement notice from a third party; a direct claim from the rightsholder or their representative.
  • F3 · Abusive use of content-matching monetisation: inserting your own content within or alongside a third party’s protected content to profit from its popularity; artificial plays on content monetised through content matching; sudden, suspicious growth without historical consistency or a plausible reason.
  • Problematic content: offensive, abusive, defamatory, obscene or pornographic content; Nazi propaganda, hate speech or endorsement of terrorism; content that is culturally insensitive; repeated submissions or flooding; generic or fake artists; generic content with little editorial value; public domain works; poor sound or artwork quality.

When we detect one of these issues, you will receive a ticket or notice explaining the potential infringement or unauthorised activity and its consequences. We may ask you to complete your account details and provide artist profiles, websites, social media profiles or other information about the artist so that we can check it against the sales data.

12.5 Strikes

A strike is applied when an F1, F2, F3 or problematic-content issue is confirmed, if you ignore our notice, or if you do not provide the requested information within 3 natural days from the day the notice is sent.

  • Strike 1: you are informed; the questioned content is taken down; earnings from the affected UPCs are withheld. If the strike is for F1 severity, your earnings share is reduced to 15%. If it is for F2 or F3 severity, the account is permanently blocked.
  • Strike 2: you are informed; the questioned content is taken down; earnings from the affected UPCs are withheld; the account is permanently blocked.

12.6 Pre-fraud notices

  • Possible copyright infringement or mention of well-known artists: the account is temporarily suspended until you resolve the notice from our quality control team. You have 30 days. If the issue is not resolved in your favour, a strike is applied and the account is permanently suspended.
  • Possibly misleading content: the account is temporarily suspended until you resolve the notice. You have 30 days. If the issue is not resolved in your favour, a strike is applied and your earnings share is reduced to 15%. A second strike for attempting to distribute potentially misleading content results in permanent suspension.

12.7 Account statuses

  • Active: no restrictions. At least one release distributed, last sign-in less than 365 days ago.
  • Prospect: no release distributed yet.
  • Inactive: at least one release distributed, last sign-in more than 365 days ago.
  • Temporarily suspended: cancelled at your request (can be reactivated); negative balance caused by penalties for artificial streaming (reactivated when the balance is positive again); pre-fraud notices (see 12.6).
  • Permanently suspended: after strikes; or when the same lead artist name is used in another account that is already permanently suspended; or when the same payment account is used in another account that is already permanently suspended for fraud; or when the same person has accounts linked to a blocked one.

12.8 Blocked accounts

If you repeatedly breach these Terms or this policy, we may end the contractual relationship and block your account. In that case:

  • all content you have distributed is kept in escrow and not monetised for five (5) years, so that it cannot be distributed again elsewhere to commit fraud. After that period it is taken down from all services. If you do not want to wait, you may request an earlier takedown, for which an administrative fee of twenty euros (20 EUR) per UPC applies;
  • legitimate earnings are held in escrow for five (5) years, under Spanish law, or until any dispute is resolved;
  • in a dispute, the parties must inform us of the outcome, so that we can determine which amounts must be returned, including expenses, claims, penalties or compensation provided for by law;
  • after five (5) years, any amounts still held in escrow are given the destination provided for by Spanish law;
  • blocked accounts cannot access the platform.

12.9 Withholding of earnings and takedowns

We may block and withhold earnings linked to content that, in our sole discretion, breaches these Terms. Those earnings are held in escrow for five (5) years, or until the dispute is resolved, to respond to: (a) a request for the return of illegitimate earnings, and (b) a claim from a legitimate rightsholder for the payment of retained earnings.

We take down confirmed infringing content in the F0, F1, F2 and F3 cases. For F3 issues we may, at our discretion, take down the whole catalogue of the account even if only part of it is involved.

12.10 Other penalties

When tracks are excluded from royalty calculations because of fraudulent plays, a penalty of fifteen euros (15 EUR) per track per month applies. It is deducted from your earnings or charged to you by pro-forma invoice.

13. Data and security

Your personal data is treated as described in our Privacy Policy. You must keep your password safe and tell us as soon as possible if you notice any unauthorised access.

14. Duration, closing and deletion of the account

  • These Terms apply while you have an account. Each distribution contract has the duration indicated in the panel and is renewed automatically while the release stays available, unless either party ends it.
  • You close the account. You can ask to close it at any time, from your panel (Settings → Account) or by writing from the email address of your account. The releases are removed from the shops within a maximum of 30 days, depending on their processing times, the subscriptions are cancelled and you lose access to the panel.
  • Collect your balance first. Before closing the account, request the withdrawal of your wallet balance. You need to reach the minimum amount shown in the wallet; amounts below that minimum may be paid only if they cover the handling costs, and otherwise they may be lost.
  • What we keep. After the account is closed we delete or anonymise your personal data, but we keep the billing documents, the records of the accepted Terms and the evidence needed to answer claims during the legal periods (as a rule, 4 years for tax matters and 5 years for civil liabilities).
  • We close the account. We may suspend or close an account immediately in case of fraud, breach of these Terms, infringement of third-party rights or requirements from the shops or from the authorities, applying the measures of section 11.
  • Unverified or inactive accounts. We may delete an account, together with its data, if its email address has not been verified within 6 months of sign-up, or if it has had no activity (no sign-in) for at least 6 months. Before deleting an account, we check that it has no balance, withdrawals, payments or subscription pending. Accounts with any of these cannot be deleted under this clause.
  • The obligations of payment, the responsibility towards third parties and the clauses that by their nature must survive (for example, indemnity or applicable law) remain in force after the account is closed.

15. Liability

The service is provided with reasonable diligence, but we do not guarantee that it is free of errors, that the shops or their reporting systems will always be available, or that earnings will reach a particular amount. To the extent allowed by law, our liability is limited to the amounts we have invoiced you in the last twelve months. Nothing in this clause limits the rights that the applicable consumer rules grant you.

You are responsible for the content you upload and for the use you make of the platform; the measures described in sections 10, 11 and 13 (withdrawal of content, retention of earnings, closing of the account or blocking of accesses) do not give you the right to compensation or a refund.

16. Changes to these Terms

We may update these Terms to adapt them to the law or to new functions of the platform. We will publish the new version here, with its version number and date, and we will tell you inside the panel. If the changes are significant, you will have to accept the new version in order to keep creating releases.

17. Applicable law and jurisdiction

These Terms are governed by Spanish law. For consumers, the courts called by the applicable rules and, otherwise, the courts of Spain shall have jurisdiction. If your claim relates to a domain name, use of the platform or copyright, we will first try to settle it through our support email.

18. Contact

For any question about these Terms, the distribution contract or your releases, write to info@srcmusic.com or open a ticket in Support from the panel.
